1. Acceptance of Terms & Legally Binding Agreement
Welcome to ReWatch ("the Platform", "we", "our", or "us"), operated by ReWatch, an independent online service operated from Kerala, India. By accessing, browsing, or using the Platform, or any of our associated services, APIs, or software, you ("User", "you", or "your") explicitly acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and ReWatch. If you do not agree to every provision of these Terms, you are expressly prohibited from using the Platform and must discontinue use immediately.
2. Platform Nature & Scope of Service
ReWatch operates as an indexing and discovery platform for third-party content. ReWatch does not intentionally host, store, upload, or distribute media files through its Services. All content indexed by the Platform is hosted by independent third-party external services. We make no representations or guarantees regarding the availability, quality, or legality of any third-party content. ReWatch functions similarly to a search engine, organizing publicly available links obtained from third-party sources. ReWatch reserves the right, at its sole discretion, to remove, delist, block, or restrict access to any indexed content, source, or link for legal, operational, security, copyright, or policy-related reasons without prior notice. ReWatch does not verify ownership, licensing status, legality, availability, or authenticity of third-party content and acts solely as an automated indexing and discovery service.
3. Eligibility
Users must meet the minimum age required under applicable law in their jurisdiction to use the Services. Where parental consent is required by applicable law, such consent must be obtained before using the Services.
4. User Accounts, Security & Responsibilities
To access certain features (such as cross-device synchronization or playlist management), you may be required to register for an account. By registering, you agree to:
- Provide true, accurate, current, and complete information as prompted by the registration form.
- Maintain the confidentiality of your password and account credentials.
- Assume full responsibility for all activities, actions, or omissions that occur under your account.
- Immediately notify ReWatch of any unauthorized use of your account or any other breach of security.
We reserve the right to suspend or terminate accounts that are suspected of unauthorized activity, or that violate these Terms, at our sole and absolute discretion without prior notice or liability.
5. Acceptable Use Policy & Prohibited Conduct
You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Platform for personal, non-commercial purposes. You strictly agree NOT to:
- Use the Platform in any manner that violates any applicable local, state, national, or international law, regulation, or statute.
- Engage in unauthorized scraping, crawling, spidering, or use of automated systems (e.g., bots, scripts) to extract data, index content, or bypass our technical limitations without our express written consent.
- Attempt to gain unauthorized access to our servers, databases, or any associated infrastructure.
- Introduce viruses, trojans, worms, logic bombs, or any other material which is malicious or technologically harmful.
- Interfere with, disrupt, or create an undue burden on the Platform or the networks connected to the Platform, including but not limited to Denial of Service (DoS) attacks.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Platform.
5.1 User-Generated Content
By submitting content to ReWatch, you represent that you possess all necessary rights to submit such content and grant ReWatch a worldwide, non-exclusive, royalty-free license to host, process, display, index, reproduce, and distribute such content solely for the purpose of operating, maintaining, improving, and displaying the Services.
5.2 Content Moderation Rights
ReWatch may remove, edit, restrict, suspend, or refuse any content, submission, account, or activity at its sole discretion for legal, security, operational, or policy reasons.
5.3 Sanctions & Export Compliance
Users may not use the Services in violation of applicable sanctions, export control laws, or trade restrictions.
6. Third-Party Links, Content & Services
The Platform contains links to third-party websites, media hosts, and services. These links are provided solely as a convenience. We do not endorse, monitor, or have any control over the content, privacy policies, or practices of any third-party websites or services. Your interaction with third-party platforms is entirely at your own risk. ReWatch is not liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third-party content, goods, or services.
6.1 No Monitoring Obligation
ReWatch is under no obligation to monitor, verify, screen, review, or investigate third-party content, links, submissions, or activities. ReWatch reserves the right, but not the obligation, to do so.
7. Intellectual Property Rights
Excluding the third-party content indexed by the search engine, all other elements of the Platform, including but not limited to the source code, design, layout, graphics, logos, and trademarks, are the exclusive intellectual property of ReWatch and are protected by applicable copyright, trademark, and intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Platform without our prior written authorization.
8. Disclaimer of Warranties
THE PLATFORM AND ALL ASSOCIATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REWATCH EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REWATCH, ITS DEVELOPERS, AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF REWATCH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REWATCH'S AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) INR 5000; OR (B) THE AMOUNT PAID BY THE USER TO REWATCH DURING THE TWELVE MONTHS PRECEDING THE CLAIM. FOR USERS WHO HAVE PAID NO FEES, LIABILITY SHALL NOT EXCEED INR 5000.
10. Indemnification
You agree to defend, indemnify, and hold harmless ReWatch, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform, including, but not limited to, your use of the Platform's content, services, and products other than as expressly authorized in these Terms.
11. Governing Law & Dispute Resolution
These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, without regard to its conflict of law provisions.
All disputes shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996. Seat of arbitration: Ernakulam, Kerala. Language: English.
Users agree to bring claims only in their individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or consolidated proceeding.
Nothing in this section limits any non-waivable rights available under applicable consumer protection laws.
12. Severability & Waiver
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
13. Modifications & Termination
We reserve the right, at our sole discretion, to modify, replace, or update these Terms at any time. Material changes will be communicated through the Platform, and continued use constitutes acceptance. We also reserve the right to suspend or terminate the Platform, your account, or your access to the Platform entirely, at any time, for any reason, with or without notice.
14. Force Majeure
ReWatch shall not be liable for delays or failures caused by events beyond reasonable control, including internet outages, cyberattacks, acts of government, natural disasters, labor disputes, infrastructure failures, or third-party service interruptions.
15. Survival
Sections relating to intellectual property, indemnification, limitations of liability, dispute resolution, privacy obligations, and governing law shall survive termination of these Terms.
16. Reserved Rights
ReWatch reserves all rights not expressly granted under these Terms. No license or right is granted by implication, estoppel, or otherwise.
17. No Reliance
Users acknowledge that they have not relied on any representation, warranty, statement, or promise other than those expressly set forth in these Terms.
18. Electronic Communications
By using the Services, users consent to receive communications electronically and agree that electronic notices satisfy any legal requirement that such communications be in writing.
19. Entire Agreement
These Terms constitute the entire agreement between the parties and supersede all prior understandings, communications, or agreements regarding the Services.
20. Assignment
ReWatch may assign or transfer its rights and obligations under these Terms without restriction. Users may not assign or transfer their rights without prior written consent.
